What This Policy Covers

This Privacy Policy covers data collection and use of information we may collect from you when you purchase or use our products or services, as well as when you visit the Site. This policy does not cover information collected by third parties on other sites, such as third parties who provide you with financing options for our products.

Collection of Personal Information

  • Directly from You: For example, applicants for credit may be asked to provide their Social Security number, their income and source of income, and their citizenship or residency status.  Visitors to the Site may be asked to provide personally identifiable information such as name, e-mail address, postal address, and phone number.  This information will be used for the purpose for which it was supplied, such as to communicate with you about our products and services.

Through these methods, we have collected the following categories of personal information from consumers within the last twelve (12) months:

  • Citizenship/residency and marital status.

Through these methods, we have also collected the following categories of sensitive personal information from consumers within the last twelve (12) months:

  • Government identifiers such as your Social Security number, driver’s license number, state identification card, or passport number.

If you are an employee or job applicant, we also collect additional categories of information from you. These are specifically identified in your Employee Notice at Collection.

Use and Disclosure of Information

We do not sell your personal information or share it with third parties for purposes of cross-context behavioral advertising.

We may use or disclose your personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason you provided the information, including to provide our products or services to you. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns.

To determine the appropriate retention period for personal information, we consider our statutory obligations, the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes we process your information for, and whether we can achieve those purposes through other means. Under some circumstances, we may anonymize your information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

Right of Residents of Certain States

If you are a resident of California, you have certain rights over your personal information under applicable state law. These include:

1) Right to Collect Inaccurate Personal Information

You have the right to request that we correct any inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information. Once we receive your verifiable consumer request and confirm your identity, we will review your request and use commercially reasonable efforts to correct the inaccurate personal information as directed by you.

2) Right to Know

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive your verifiable consumer request and confirm your identity, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling your personal information.
  • The categories of third parties with whom we share your personal information.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
  • The specific pieces of personal information we collected about you (also called a data portability request).

3) Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive your verifiable consumer request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights

Only you, or someone legally authorized to act on your behalf, may make a request. You may designate an authorized agent by sending a written and signed authorization to Novus Ag, 3420 E. Harmony Rd., Suite 122, Fort Collins, CO 80528.

You may also make a request to know or delete on behalf of your child by sending us a request on behalf of your child with the appropriate documentation.

We will confirm receipt of your request within ten (10) business days, and will endeavor to substantively respond within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

We will not discriminate against you for exercising any of your above-listed rights.

Policy Towards Minors

The Site is not intended for children under 16 years old and we do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Site or provide any information about yourself to us, including your name, address, telephone number, or email address. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.
